Department of Labor Rolls Back Reporting Requirements to Protect Employee Privacy

OSHA Rolls back reporting requirements for Employee Privacy

OSHA issued final rule eliminating requirement for electronic submission of Forms 300 and 301

  1. Form 300 - Log of Work-Related Injuries and Illnesses
  2. Form 301 - Injury and Illness Incident Report

 - Maintenance of these forms are still required on-site and are still subject to inspections and enforcement actions

- Eliminating electronic reporting avoids risk of personal information being publicly disclosed under the Freedom of Information Act (FOIA)

- Form 300A (Summary of Work-Related Injuries and Illnesses) still requires electronic submission

OSHA has determined that this final rule will allow OSHA to improve enforcement targeting and compliance assistance, protect worker privacy and safety, and decrease burden on employers.
